New Delhi, June 4, 2025 — In a significant ruling, the Delhi High Court has quashed an FIR filed against a man accused of causing discomfort to a woman passenger by allegedly staring at her continuously during a flight from Indore to Delhi. The case, titled Prashant Pareek v. State Govt. of NCT of Delhi & Anr, was decided by Justice Ravinder Dudeja, who noted that the issue had been amicably resolved between both parties and further legal proceedings would serve no purpose.
Background of the Case
The FIR (No. 370/2024) was registered under Section 509 of the Indian Penal Code (IPC) at IGI Airport Police Station, based on a complaint by a woman who alleged that Prashant Pareek, her co-passenger, stared at her inappropriately during the flight, causing her mental discomfort. Upon landing in Delhi, the woman lodged a written complaint with the police, prompting formal legal action.
Settlement and Court Observations
However, during the legal proceedings, both parties decided to settle the matter amicably. A Settlement Agreement was executed with the help of mutual friends and well-wishers, and the prosecution raised no objections to the quashing of the FIR.
Justice Dudeja, acknowledging the peaceful resolution and the absence of any further dispute, observed:
“In view of the aforesaid circumstances and the fact that parties have put a quietus to the dispute, no useful purpose will be served in continuing with the present FIR No. 370/2024… along with all the other consequential proceedings emanating therefrom.”
Court’s Decision
The High Court, invoking its powers in the interest of justice, allowed the petition filed by the accused and officially quashed the FIR and all related proceedings. This judgment reflects the Court’s approach of encouraging reconciliation in minor, non-violent disputes, especially where the parties have mutually resolved their differences.
Legal Takeaway
This case is an example of how the judiciary promotes settlement over litigation in appropriate cases, particularly where the offense is not of a grave or violent nature. Section 509 IPC deals with words, gestures, or acts intended to insult the modesty of a woman, and while such allegations are taken seriously, courts are also open to quashing FIRs in light of genuine settlement and mutual understanding.
